Preamble
The General Data Protection Regulation (GDPR) came into force on May 25, 2018 and completes the legislation on the protection of personal data.
Personal data corresponds to any information relating to a natural person who is identified or can be identified, directly or indirectly, by reference to an identification number or to one or more elements specific to that person (surname, first name, address, e-mail, telephone, contract number, CB number, …).
The processing of personal data refers to any operation performed on this type of data (collection, storage, transmission, deletion, etc.), whether on paper or by computer. The data controller is the person who determines the purposes of each processing operation and the means of achieving these purposes.
For Portmann, protecting your data is a priority. Therefore, in the interests of transparency, this Privacy Policy aims to explain to you why your personal data is collected and processed by Portmann, in its capacity as data controller, how it is processed, what rights you have to your data and how you can exercise them.
Portmann reserves the right to modify this Privacy Policy at any time. Any changes will take effect immediately.

1. Why does Portmann need to collect your data?
The data Portmann collects is hosted in France using secure protocols.
The legal basis for this processing is your contractual relationship with Portmann and/or Portmann’s legal or regulatory obligations, or your consent, in the case of commercial prospecting, which you may withdraw at any time by sending us an email to the following address: f.kessler@transports-portmann.com.
In general, Portmann does not process any of your data for purposes incompatible with those for which it was collected, unless you have given your prior consent.

3. What data does Portmann collect?
Portmann, as data controller within the meaning of the RGPD, limits the collection of personal data to data that is adequate, relevant and strictly necessary for the performance of its activities
With regard to persons outside Portmann, the data collected is :
personal data necessary for Portmann’s product sales activities, i.e. :
the surnames, first names, personal details, functions, e-mail addresses and telephone numbers of any person who has expressed an interest in and consented to receiving information from Portmann.

4. Data transmission
Your personal data will only be passed on to our partners for the purpose of ensuring the proper performance of Portmann’s activities, in particular :
staff
service providers involved in our digital communications or events, within the framework of subcontracting agreements and therefore subject to their own commitments to respect regulations relating to the protection of personal data.
organizations, legal auxiliaries and ministerial officers, as part of their debt collection mission;

5. How long is your data stored?
Your data will be kept by Portmann for as long as is necessary to achieve the purposes set out in point 1 of these terms and conditions, plus any statutory limitation periods.
Concerning data required for the performance of contractual relations with Portmann or to comply with a legal obligation
This data is kept for the duration of the contractual relationship. After the contract has been fulfilled, Portmann may archive some of your data to meet accounting or tax obligations or for evidential purposes, in the event of a dispute or claim, subject to the applicable statute of limitations.

Concerning data collected on the basis of your consent
Data used for commercial prospecting purposes may also be kept until the person concerned withdraws his/her consent, or failing that, for a period of 3 years from the last contact the customer/prospect had with Portmann (for example, if you are a customer, this period runs from registration; if you are a prospect, from clicking on a hypertext link contained in an e-mail, from a request for documentation, etc.). At the end of this three-year period, Portmann will contact you to find out whether you wish to continue receiving commercial solicitations.
Concerning data collected on the basis of Portmann’s legitimate interest, i.e. :
To ensure the management of requests received via the present site: the data collected will be kept for the time required to process the request.

You have the right to request access to your personal data and the rectification of inaccurate data.
You may request the erasure of data and the restriction of processing, in accordance with applicable law.
You have the right to the portability of the personal data you have provided to the school, in accordance with applicable legislation. 
This right only applies to data that you have actively and knowingly provided to Portmann (for example, data that you have entered in an online form) or data generated when using a service or device in the context of concluding or managing your contract, and which is processed automatically, on the basis of consent or the performance of a contract.
You may object to your data being used by the Portmann School for a specific purpose. In this case, you must put forward reasons relating to your particular situation, except in the case of commercial canvassing, to which you may object without reason and at any time.
When the processing of your personal data is based on your consent (e.g. the sending of our electronic commercial offers), you may withdraw your consent at any time.

All requests must specify the purpose of the request (exercise of right of access, opposition, etc.). Moreover, if there is any doubt about the identity of the person making the request, we may ask you to provide proof of identity.

7. How does Portmann secure the processing of your data?
Portmann implements all technical, physical and organizational measures to ensure the security and confidentiality of your data during collection, processing and transfer.
Portmann’s infrastructures are protected against malicious software (viruses, spyware, etc.); the security of your terminal is your responsibility.
If we are likely to use service providers to process part of your data, we undertake to check that they offer sufficient guarantees to ensure the protection of the personal data entrusted to them and to have them sign the necessary confidentiality clauses.

8. Social networks
Portmann is present on the Social Networks via a Linkedin account.
Access to these Social Networks implies your prior acceptance of its contractual conditions, including its commitments with regard to the RGPD for the processing carried out by the latter, and this independently of our page on the said Social Network.
